Partners stand in a fiduciary relation to one another in all matters pertaining to the partnership. The partnership relationship is one of honesty, good faith, fairness, and loyalty. It imposes upon the partners the highest standards of care, the duty to act for the common benefit of all partners in transactions relating to the business, and the duty to refrain from taking advantage of one another by any misrepresentation, concealment, threat, or adverse pressure relating to the partnership and its business.


It can be argured that this statement is largely true for functional families. For families it can be re-written as follows:

Family members stand in a fiduciary relation to one another in all matters pertaining to the family. The family relationship is one of honesty, good faith, fairness, and loyalty. It imposes upon the family members the highest standards of care, the duty to act for the common benefit of all family members in matters relating to the family, and the duty to refrain from taking advantage of one another by any misrepresentation, concealment, threat, or adverse pressure relating to the family and its business.


Opinions will vary about the exact extent to which the principles of fiduciary duty apply to family relationships. Courts have consistently held that marital partners most certainly have a fiduciary relationship to each other. Courts have also held consistently that parents have serious duties and obligations to their children. Some of these duties and obligations would involve the same disclosures or actions that fiduciary duties between partners would require. In other cases parental duties to their minor children exceed the fiduciary duties of partnership.

The area of sibling duties to each other, and children's duties to their parents would be where the widest range of opinions might be found that could stray somewhat from the obligations and disclosures required by the fiduciary duties of partners.

Be that as it may, most would agree that in the event of a natural disaster, such as a hurricane, earthquake or tornado, functional families promptly make inquiries about the awareness, preparedness and safety of their loved ones. Where a family member is found to be in danger or in need, functional families promptly do what they reasonably can to address the need.

These inquiries and supportive actions are generally seen as family obligations as well as manifestations of loving concern. This type of activity would almost universally include the parents, children, siblings, and other loved ones in or of a family. It is generally understood and accepted in most cultures that the family obligation to this type of attentiveness about the safety and wellbeing of family members exceeds the level of attentiveness with which they are obliged to others, outside the family circle of love and trust.
